If a person is arrested for driving under the influence or driving while ability impaired and has been convicted of either offense at least twice previously, the bill requires the court to impose the following conditions on the person's bail bond:
Participation in a substance abuse treatment program;
Electronic monitoring;
Drug or alcohol testing; and
Use of an interlock device, if appropriate.
A defendant may file a motion with the court for relief from any of the above conditions. The court must conduct a hearing to determine whether the conditions are in the interest of justice and serve the public safety. If the court waives any of the conditions, it must provide a written order explaining the decision.
