The primary points of concerns are:

• If a qualified student concurrently enrolls, the local education provider that enrolls the qualified student must pay to the enrolling institution of higher education an amount equal to 5% of the local education provider's per pupil revenue for each credit hour in which the qualified student enrolls.
• The superintendent or principal may deny the qualified student's request to concurrently enroll only on the basis of documented evidence that the qualified student is not behaviorally or academically prepared to enroll in postsecondary courses.
• If a superintendent or principal denies a qualified student's request to enroll, the denial must be in writing with the reasons for the denial. The qualified student may appeal the denial to the governing board of the local education provider, and the governing board shall consider the appeal no later than the next regular meeting. If the governing board denies the appeal, the qualified student may appeal the denial to the state board of education, and the state board shall consider the appeal no later than its next regular meeting.

Based on very rough calculations, we would pay ~$350 for each credit hour (FRCC charges $119.50 per credit hour so would make a huge profit).  With our current CE budget of ~$120K (likely much higher than most districts in the state), we would be able to offer only 343 credits, or about 115, 3-credit courses per year.  This semester alone we support over 250 students in courses with an approximate total credit count of 1000 credits.  If this bill passed, we would be on the hook for approximately $350,000 this semester alone.  In addition, we denied many student requests for various reasons.  If we essentially had to approve any request, as stipulated in the proposed legislation, our costs would rise further.  

These are rough estimates, but I think you can see how this legislation would make concurrent enrollment prohibitively expensive.
